NSW Fair Trading provides a free dispute resolution process to help resolve any issues, between consumers and traders that arise throughout the building process.

If you do not receive a payment schedule in the required number of business days after making a claim, or you are not paid by the due date, there are two things you should do to recover outstanding payments.

Apply for adjudication

Adjudication is an independent, less formal way to resolve a claim quickly and inexpensively. Find out how to apply for adjudication on the Fair Trading website. You may also want to get independent legal advice about commencing action in an appropriate court.
